We are thrilled to have you on board as you send your parcels with us. Before you begin, we kindly request that you familiarize yourself with the following terms and conditions that govern your use of the Platform.

These terms and conditions (“Terms”) constitute a binding agreement between you (“Customer, User, or you”) and Vacation Logistics, DMCC dba SendItHome (“Vacation Logistics, DMCC dba SendItHome, We, Us, Our”) for the use of the Platform. You must be at least 18 years of age to use the Platform. By using the Platform and agreeing to these Terms, you represent and warrant that you are at least 18 years of age. In order to proceed with the use of the Platform, it is essential that you agree to these Terms. We strongly encourage you to carefully review and understand these Terms in order to address any questions or concerns you may have. Our dedicated team is available to provide further clarification or assistance as needed.

 

  1. APPLICATION
    These Terms and Conditions govern the use of Vacation Logistics, DMCC dba SendItHome’s Platform and the services provided by Vacation Logistics, DMCC dba SendItHome. By accessing or using our Platform, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access or use our platform.

 

  1. DEFINITIONS AND INTERPRETATIONS
    1. In these Terms, unless the context otherwise required, the following expressions shall have the following meanings:

      Vacation Logistics, DMCC dba SendItHome: the entity stated in these Terms having ownership and control over the Platform and providing the Services to Customers.
      Charges: the charges payable by the Customer for the Services in accordance with clause 12 (Charges and Payment).
      Customer: the individual who subscribes to the use of the Platform and Services under these Terms.
      Customer Data: the data provided by the Customer for the purpose of registering an account with the Platform.
      Data Protection Legislation: means:

      1. The General Data Protection Regulation (GDPR), 2016 the Data Protection Act 2018, the Privacy and Electronic Communications (EC Directive) Regulations 2003;
      2. The Federal Law No. 1 of 2006 on Electronic Commerce and Transactions, The Federal Law No. 7 of 2002 Concerning Copyrights and Related Rights and where applicable, the Dubai International Financial Centre (DIFC) Data Protection Laws; and
      3. Any other legislation in force from time to time relating to privacy and/or the Processing of Personal Data in the jurisdiction where the Services are being provided and applicable to the provision of the Services under these Terms; and any statutory codes of practice issued by the Information Commissioner in relation to such legislation.
        Personal Data and Processing: have the meaning given to it in the Data Protection Legislation.

      Services: Services refer to the offerings provided by Vacation Logistics, DMCC dba SendItHome, designed to facilitate the efficient and convenient shipment of packages for hotel customers to their preferred destinations at reduced rates. The Services shall include but are not limited to Package Shipment, International Shipping, and Partnership with Hotel Groups and Third-Party Logistics Providers, Order Placement and Tracking. The Services aim to simplify and streamline the package shipping process for hotel customers, offering them a reliable and cost-effective solution for sending their belongings to desired destinations. By leveraging partnerships with hotel groups and trusted logistics providers, Vacation Logistics, DMCC dba SendItHome ensures a seamless and efficient experience for its customers, meeting their shipping needs with ease and convenience.
      Shipment: refers to the transportation and delivery of packages booked and facilitated through Vacation Logistics, DMCC dba SendItHome’s logistics Platform.

    2. A reference to a statute or statutory provision is a reference to it as amended or re-enacted. A reference to a statute or statutory provision includes all subordinate legislation made under that statute or statutory provision. Any reference to a singular term within these Terms and Conditions includes the corresponding plural form. Likewise, any reference to a plural term also encompasses the singular form. Any reference to a party, individual, or participant within these Terms is inclusive of all genders. “In Writing” specifies that any communication, notice, or documentation required or permitted under these Terms may include traditional written forms, electronic communication, or any other form agreed upon by the Parties.

 

  1. BASIS OF THESE TERMS AND CONDITIONS.
    These Terms and Conditions shall come into effect when the Customer completes the account opening process and makes payment for a Shipment. The Terms apply to the exclusion of and shall prevail over any other terms that the Customer may attempt to impose or incorporate, or that are implied by trade, custom, practice or course of dealing.

 

  1. USER ACCOUNTS AND REGISTRATION
    1. To create an account on the Platform, users can access the signup page by scanning the QR code found in brochures or flyers available in their hotel rooms or at the hotel reception. We will require you to provide your name, email address, and choose a password. An OTP (One-Time Password) is sent to your email inbox to validate your email address. Once registered, you can start creating shipping orders. The Platform also offers a profile tab where users can provide their home address and contact details.
    2. During the registration process, Vacation Logistics, DMCC dba SendItHome collects the following information: user’s name, email ID, and desired password. This information is necessary to create and manage user accounts on the Platform. When creating an account, you must provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and are solely responsible for any activity that occurs under your account.
    3. Vacation Logistics, DMCC dba SendItHome requires users to be at least 18 years old to create an account and use its services. This ensures that you are capable of entering into a legally binding agreement. By accessing or using our platform, you represent and warrant that you meet these eligibility requirements.
    4. Vacation Logistics, DMCC dba SendItHome reserves the right to terminate or suspend your account at any time without notice if we believe you have violated these Terms and Conditions or engaged in fraudulent, abusive, or unlawful activities.

 

  1. ORDER PLACEMENT
    • Customers staying at hotels can conveniently place orders through our Website to have their goods shipped to international addresses. Please note that all orders are subject to acceptance by Send It Home, and once placed, they cannot be cancelled or modified, unless required by applicable law.
    • We offer international shipping services to most countries, but it is essential for users to ensure that the items being shipped comply with all relevant import and export regulations. It is the sole responsibility of the customer to ensure that their shipments adhere to any restrictions imposed by local laws, regulations, or trade embargoes.
    • We have established partnerships with reputable third-party logistics companies, including renowned providers like FedEx and DHL, to handle the transportation, customs clearance, and delivery of parcels. The selection and engagement of these logistics providers are solely determined by Send It Home, ensuring reliable and efficient shipping services for our customers.

 

  1. SERVICE DESCRIPTION
    1. Vacation Logistics, DMCC dba SendItHome provides a comprehensive range of logistics and courier services through its Platform to facilitate the efficient and convenient shipment of packages for hotel customers. These services include but are not limited to the following:
      1. Package Shipment Services: Vacation Logistics, DMCC dba SendItHome’s core service revolves around package shipment, enabling hotel guests to send their packages to their preferred destinations with ease. Through the platform, Customers can place shipping orders, specify pickup and delivery details, and select the appropriate packaging options.
      2. Global Reach: Vacation Logistics, DMCC dba SendItHome operates on a global scale, catering to customers from over 200 countries. Whether you are an American, European, Chinese, or any international traveler, Vacation Logistics, DMCC dba SendItHome’s services are designed to serve your shipping needs.
      3. Approved Hotel Group Properties: Vacation Logistics, DMCC dba SendItHome collaborates with renowned hotel group properties, including Marriott, Hilton, and others, to offer its services directly to their guests. This partnership ensures a seamless integration of Vacation Logistics, DMCC dba SendItHome’s logistics services within the hotel environment, making it convenient for Customers to access and utilize the shipping services during their stay.
      4. Partnership with Third-Party Logistics Providers: To facilitate reliable and efficient package transportation, Vacation Logistics, DMCC dba SendItHome has established partnerships with leading third-party logistics providers, such as FedEx, DHL, UPS and many others. These trusted logistics partners are responsible for the physical pickup, transportation, and delivery of packages, ensuring timely and secure shipment.
      5. International and Domestic Shipping: Vacation Logistics, DMCC dba SendItHome specializes in international shipping, allowing Customers to send packages to various countries around the world. From Europe to Asia, North America to South America, Vacation Logistics, DMCC dba SendItHome covers a wide range of international destinations. Additionally, within the United States of America, Vacation Logistics, DMCC dba SendItHome offers domestic shipping services, enabling Customers to send packages across states.
      6. Easy Order Placement and Tracking: Vacation Logistics, DMCC dba SendItHome’s Platform offers a user-friendly interface, allowing Customers to easily place shipping orders and track the progress of their shipments. Once an order is placed, Customers can conveniently monitor the status of their packages, from pickup to delivery, through the tracking system provided by Vacation Logistics, DMCC dba SendItHome.
      7. Compliance with Customs and Regulations: For international shipments, Vacation Logistics, DMCC dba SendItHome ensures compliance with customs regulations and requirements of the countries involved. Customers are responsible for verifying and adhering to any import/export restrictions, as well as providing accurate and complete customs declarations or commercial invoices for their packages.

  1. PARCEL PACKAGING
    1. Notwithstanding anything to the contrary and for the purpose of complying with applicable laws, regulations, and courier restrictions, it is agreed that the packaging of parcels to be shipped through Vacation Logistics, DMCC dba SendItHome services will be exclusively handled by the designated staff at the hotel where the Customer is staying.
    2. The designated staff will be responsible for ensuring that the parcels are properly packed, labeled, and comply with all relevant shipping requirements, including but not limited to customs laws, export and import controls, and hazardous materials regulations.

 

  1. PARCEL RESTRICTIONS AND LIMITATIONS
    1. Vacation Logistics, DMCC dba SendItHome imposes certain restrictions on the types of parcels that can be sent through the Platform. This policy is in place to maintain the integrity of the service, comply with legal requirements, and ensure the safety and security of all users and personnel involved in the shipping process. Users are strictly prohibited from shipping items that are considered illegal, dangerous, or prohibited by law. Such items include, but are not limited to, explosives, firearms, ammunition, drugs, hazardous materials, contraband, live animals, perishable goods, and any items that infringe upon intellectual property rights or violate any applicable regulations.
    2. The specific list of prohibited items may vary depending on the country of origin and destination. Customers are responsible for familiarizing themselves with the specific regulations and restrictions applicable in their respective countries. It is the customer’s sole responsibility to ensure that the contents of their packages comply with all legal shipping regulations, including customs requirements, import/export restrictions, and any other applicable laws. Vacation Logistics, DMCC dba SendItHome reserves the right to refuse the shipment of any package that violates these restrictions or poses a risk to the safety and well-being of individuals or property.

To facilitate the shipping process and ensure compliance with customs and regulatory requirements, each item being shipped through Vacation Logistics, DMCC dba SendItHome’s service must be accompanied by a clear and accurate description. This description should be provided in a commercial invoice or customs declaration, as required by the applicable authorities. The invoice or declaration should include details such as the nature of the item, its quantity, value, country of origin, and any other relevant information that may be necessary for customs clearance.
    4. By adhering to these restrictions and requirements, Customers can help maintain the integrity and efficiency of Vacation Logistics, DMCC dba SendItHome’s Services, while ensuring compliance with legal and regulatory obligations. Vacation Logistics, DMCC dba SendItHome reserves the right to inspect and verify the contents of any package to ensure compliance with these Terms and applicable laws. Failure to comply with these restrictions may result in the refusal of service, cancellation of shipments, and legal consequences as per the applicable laws and regulations.

 

  1. USAGE POLICY
    1. Vacation Logistics, DMCC dba SendItHome grants you a limited, non-exclusive, non-transferable, and revocable license to access and use our Platform for its intended purpose. This license does not permit you to modify, adapt, translate, reverse engineer, or create derivative works from the Platform.
    2. When using our platform, you agree to:
      1. Comply with all applicable laws, regulations, and third-party agreements;
      2. Not engage in any fraudulent, deceptive, or unlawful activities;
      3. Not impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity;

      5. Not collect or store personal information of other users without their consent; and
      6. Not attempt to gain unauthorized access to any part of the platform or its systems.
    1. You retain ownership of any content you submit or upload to our Platform. By providing content, you grant Vacation Logistics, DMCC dba SendItHome a worldwide, fully paid-up, royalty-free, non-exclusive, sub-licensable, and transferable license to use, reproduce, distribute, modify, adapt, publicly perform, and display such content for the purpose of providing our Services.

 

  1. PROHIBITED USE AND COMPLIANCE WITH LAWS

Your use of our Services is subject to the condition that you shall only use them for lawful purposes and in strict compliance with these Terms, as well as all applicable laws and regulations in the jurisdictions where you access and utilize our Services. You hereby represent and warrant that you possess all necessary permits, licenses, and authorizations required for the lawful shipment of your packages.
    3. You explicitly agree that our Services shall not be utilized to send items that are expressly prohibited by applicable laws, regulations, or courier restrictions. Such prohibited items may include, but are not limited to:
      • Illegal or controlled substances
      • Firearms, ammunition, and explosives
      • Animals, plants, or other living organisms
      • Human remains or body parts
      • Obscene or pornographic materials
      • Counterfeit or pirated goods
      • Items that infringe upon intellectual property rights
      • Items that may cause harm or damage to property, individuals, or the environment
    4. You are strictly prohibited from engaging in any fraudulent, harmful, or illegal activities through our Platform. These activities include, but are not limited to:
      1. Misrepresenting your identity or affiliation with any individual or organization
      2. Accessing or attempting to access any part of our Platform without proper authorization

    3. The pricing structure for Vacation Logistics, DMCC dba SendItHome’s services is based on the postal codes provided by the User. By utilizing the advanced functionality of the third-party logistics provider’s API, the Platform automatically calculates the all-inclusive price for the selected parcel delivery service. This ensures transparency and accuracy in determining the cost associated with each shipment.
    4. Vacation Logistics, DMCC dba SendItHome supports multiple payment methods to offer flexibility and convenience to Customers. In addition to debit cards and credit cards, the platform accepts various other payment options that are compatible with the secure Stripe payment system. For detailed information regarding the available payment methods, Users are encouraged to visit the official Stripe website, where comprehensive information is provided on the range of payment options supported.

 

  1. CANCELLATION AND REFUNDS
    1. Cancellation by Customers
      1. Vacation Logistics, DMCC dba SendItHome has a strict policy regarding the cancellation of orders. Customers have the right to cancel their shipment orders placed through Vacation Logistics, DMCC dba SendItHome before payment is made. However, the cancellation terms and eligibility for refunds may vary depending on the specific circumstances and the stage of the shipment process. Once an order has been placed and paid for, cancellation shall not be allowed.

      3. If a customer cancels their shipment after it has been dispatched or picked up, the cancellation will be subject to the terms and conditions of the logistics provider involved.     2. Cancellation by Vacation Logistics, DMCC dba SendItHome

      2. Tracking Information: We provide tracking information for all shipments. You can track your parcel’s progress through the Vacation Logistics, DMCC dba SendItHome platform using the unique tracking number provided. While we make every effort to provide accurate and up-to-date tracking information, please note that occasional delays or inaccuracies may occur due to factors beyond our control.

In the event that Vacation Logistics, DMCC dba SendItHome fails to meet the specified service level commitments, our liability is limited to the refund of the shipping fees paid for the affected shipment. The responsibility for the actual delivery of parcels rests solely with the selected logistics provider. We work with reputable and reliable logistics providers to ensure efficient and timely delivery. However, factors such as customs clearance procedures, weather conditions, transportation disruptions, or other unforeseen events may impact the delivery timeline.
    4. Vacation Logistics, DMCC dba SendItHome will provide users with relevant tracking information to monitor the progress of their shipments. This information is sourced from the logistics provider and is subject to their updates and reporting. In the event of a delay or issue with the delivery of a parcel, Vacation Logistics, DMCC dba SendItHome will diligently liaise with the logistics provider to address and resolve the situation to the best of its ability. However, any claims, disputes, or liability arising from delivery delays or issues are ultimately between the user and the logistics provider.

    3. Vacation Logistics, DMCC dba SendItHome does not guarantee the availability, reliability, or uninterrupted access to the platform. You acknowledge that the platform may be subject to maintenance, upgrades, or other technical issues that may temporarily disrupt its accessibility.
    4. Vacation Logistics, DMCC dba SendItHome acts as an intermediary platform connecting customers with logistics providers for the purpose of facilitating shipment services. While Vacation Logistics, DMCC dba SendItHome makes reasonable efforts to ensure the quality and reliability of the logistics providers, Vacation Logistics, DMCC dba SendItHome shall not be held liable for any damages, losses, delays, or errors caused by the logistics providers’ actions or omissions.
    5. Vacation Logistics, DMCC dba SendItHome does not assume any responsibility for the condition, safety, or integrity of the shipped items. It is the customer’s responsibility to ensure proper packaging and compliance with applicable regulations for the items being shipped. Vacation Logistics, DMCC dba SendItHome shall not be liable for any damages, losses, or claims arising from the packaging, handling, or transportation of the items. In no event shall Vacation Logistics, DMCC dba SendItHome’s total liability, whether in contract, tort (including negligence), or otherwise, exceed the total amount paid by you for the specific shipment service giving rise to the claim.

 

  1. INDEMNIFICATION
    1. You agree to indemnify, defend, and hold harmless Vacation Logistics, DMCC dba SendItHome and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with:
      1. Your use of the Vacation Logistics, DMCC dba SendItHome platform and services,
      2. Any violation of these Terms and Conditions,
      3. Any breach of your representations or warranties,
      4. Any infringement of intellectual property rights or other rights of third parties,
      5. Any unauthorized use or access to the Vacation Logistics, DMCC dba SendItHome platform,
      6. Any actions or omissions by you that result in harm, damage, or injury to any third party,
      7. Any violation of applicable laws, regulations, or industry standards.
    2. Vacation Logistics, DMCC dba SendItHome reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such case, you agree to cooperate with Vacation Logistics, DMCC dba SendItHome in asserting any available defenses.
    3. Vacation Logistics, DMCC dba SendItHome will promptly notify you of any claim or action for which it seeks indemnification. You agree to promptly provide Vacation Logistics, DMCC dba SendItHome with all necessary information, assistance, and cooperation to defend such claims or actions.

 

  1. DISPUTE RESOLUTION
    1. In the event of any disputes or disagreements arising between Vacation Logistics, DMCC dba SendItHome and the Customer, the following dispute resolution process shall be followed:
      1. Customers are encouraged to first contact Vacation Logistics, DMCC dba SendItHome’s customer support team to raise their concerns or disputes. Vacation Logistics, DMCC dba SendItHome is committed to providing prompt and efficient assistance in addressing and resolving any issues that may arise. The customer support team will make reasonable efforts to investigate the matter and provide a satisfactory resolution within a reasonable timeframe.
      2. If the dispute remains unresolved after engaging with customer support, both parties agree to participate in mediation in an attempt to reach a mutually agreeable resolution. The mediation process will be facilitated by a neutral and independent third party, chosen by mutual agreement or appointed by a recognized mediation organization. Both Vacation Logistics, DMCC dba SendItHome and the user shall actively engage in the mediation process in good faith and with a willingness to find a fair and equitable solution. The costs associated with mediation, including the mediator’s fees, shall be shared equally between both parties, unless otherwise agreed upon.
      3. If mediation is unsuccessful in resolving the dispute, both parties agree to submit the matter to binding arbitration. The arbitration shall be conducted in accordance with the rules and procedures of an internationally accepted arbitration organization to be selected by Vacation Logistics, DMCC dba SendItHome. The arbitration process shall be conducted by one or more impartial arbitrators appointed in accordance with the chosen arbitration organization’s rules. The decision rendered by the arbitrator(s) shall be final and binding on both Vacation Logistics, DMCC dba SendItHome and the Customer. Both parties agree to abide by the arbitration decision and waive any right to further litigation in relation to the dispute.
      4. Notwithstanding the above, either Party may seek injunctive relief or pursue legal action to protect their rights or interests related to intellectual property, confidentiality, or unauthorized use of the Platform.
      5. This dispute resolution process is intended to provide a fair and efficient mechanism for resolving disputes between Vacation Logistics, DMCC dba SendItHome and its users. By using the Vacation Logistics, DMCC dba SendItHome platform and services, you acknowledge and agree to engage in good faith efforts to resolve any disputes through the outlined process before pursuing other legal remedies.

 

  1. INTELLECTUAL PROPERTY
    1. The Vacation Logistics, DMCC dba SendItHome Platform, including its website, mobile applications, software, databases, algorithms, designs, logos, trademarks, trade names, and other related intellectual property rights, are the exclusive property of Vacation Logistics, DMCC dba SendItHome or its licensors. All rights, title, and interest in and to the Vacation Logistics, DMCC dba SendItHome intellectual property are and shall remain with Vacation Logistics, DMCC dba SendItHome.
    2. As a user of the Vacation Logistics, DMCC dba SendItHome platform, you retain ownership of any intellectual property rights in the content you submit, upload, or transmit through the platform (“User Content”). A correctly addressed notice sent by pre-paid first-class post or recorded delivery post shall be deemed to have been received at the time at which it would have been delivered in the normal course of post. A notice sent email shall be deemed to have been received at the time of transmission (as shown by the time sent in respect of an email).

 

  1. TERMINATION AND SUSPENSION
    1. Termination by Vacation Logistics, DMCC dba SendItHome
      1. Vacation Logistics, DMCC dba SendItHome reserves the right to terminate your access to the Vacation Logistics, DMCC dba SendItHome platform and services in the following circumstances:
        1. Breach of Terms: If you violate any of the terms and conditions outlined in this agreement or fail to comply with applicable laws and regulations, Vacation Logistics, DMCC dba SendItHome may terminate your access to the platform with immediate effect.
        2. Non-Payment: If you fail to make payment for services rendered within the specified timeframe, Vacation Logistics, DMCC dba SendItHome may suspend or terminate your access to the platform until outstanding payments are settled.
        3. Misuse of Platform: If you engage in fraudulent activities, misuse the platform, or attempt to undermine the security or integrity of the Vacation Logistics, DMCC dba SendItHome system, your access may be terminated.
      2. Upon termination, you will no longer be able to use the Vacation Logistics, DMCC dba SendItHome platform or access any related services. Any outstanding obligations or liabilities, including unpaid fees or charges, will remain payable.
      3. Termination by Customer
        You have the right to terminate your account and cease using the Vacation Logistics, DMCC dba SendItHome platform at any time by providing written notice to Vacation Logistics, DMCC dba SendItHome. Upon termination, any unused credits or funds in your account will be subject to the refund policy outlined in these Terms and Conditions.
      4.  Suspension
        1. Vacation Logistics, DMCC dba SendItHome reserves the right to suspend your access to the Platform temporarily in the following circumstances:
